1. Acceptance of Terms
By accessing or using Zuri Marketplace ("Zuri", "we", "our", "the platform") at zurimarket.co.ke, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the platform.
We reserve the right to update these terms at any time. Continued use of the platform after changes constitutes acceptance of the revised terms.
2. About Zuri Marketplace
Zuri Marketplace is a digital marketplace platform that connects independent Kenyan fashion vendors with buyers. We operate as a marketplace intermediary only — we do not manufacture, stock, or own any products listed on the platform.
What Zuri Marketplace Does
- Provides a digital storefront for verified Kenyan vendors
- Facilitates discovery of products by buyers
- Connects buyers with vendors via WhatsApp
- Promotes vendors through marketing and social media
- Maintains platform standards and vendor verification
What Zuri Marketplace Does Not Do
- We do not hold inventory or warehouse products
- We do not process payments between buyers and vendors
- We are not a party to any transaction between buyer and vendor
- We do not guarantee the quality, accuracy or legality of any listing
3. Buyer Terms
3.1 Browsing and Ordering
Buyers may browse products on Zuri Marketplace freely without creating an account. When a buyer contacts a vendor via WhatsApp, the buyer enters into a direct agreement with that vendor — not with Zuri Marketplace.
3.2 Buyer Responsibilities
- Verify product details, prices and availability directly with the vendor
- Confirm delivery terms, areas and timelines before paying
- Pay vendors directly via M-Pesa or agreed payment method
- Keep payment confirmation receipts (M-Pesa transaction IDs)
- Report fraudulent vendors to Zuri Marketplace immediately
3.3 Buyer Rights
- To receive accurate product descriptions from vendors
- To know delivery timelines before payment
- To contact Zuri Marketplace if a vendor is unresponsive after payment
- To report vendors who violate platform standards
4. Vendor Terms
4.1 Vendor Eligibility
To sell on Zuri Marketplace, vendors must:
- Be based in Kenya and operate a legitimate business
- Sell genuine, original products — no counterfeit goods
- Have an active WhatsApp number for customer communication
- Respond to customer enquiries within 24 hours
- Accept and complete orders in good faith
4.2 Vendor Subscription
Vendors are subscribed at Ksh 1,499 per month, payable after their first successful sale. Zuri Marketplace does not charge commission per sale — only the flat monthly subscription fee applies.
4.3 Vendor Obligations
- Maintain accurate product listings and prices
- Fulfill orders promptly and as described
- Communicate professionally with buyers
- Not list prohibited items (see Section 6)
- Not direct buyers to other platforms to circumvent the subscription
- Accept responsibility for all transactions with buyers
4.4 Vendor Content
By submitting product photos and descriptions to Zuri Marketplace, vendors grant us a non-exclusive licence to display, promote and market their products across our platform and associated social media channels.
5. Payments & Transactions
All payments between buyers and vendors are made directly — typically via M-Pesa. Zuri Marketplace is not a payment processor and does not hold funds on behalf of either party.
5.1 Payment Safety
- Always confirm M-Pesa payment details directly with the vendor via WhatsApp
- Save your M-Pesa transaction confirmation (message reference number)
- Do not make payment to personal numbers without verifying with the vendor first
- Report any suspicious payment requests to richard@zurimarket.co.ke immediately
5.2 Refunds & Returns
Refund and return policies are set by individual vendors. Buyers should confirm return policies directly with vendors before purchase. Zuri Marketplace encourages vendors to have fair and clear return policies.
6. Prohibited Content & Conduct
Vendors may NOT list or sell:
- Counterfeit, fake or replica branded goods
- Stolen or illegally obtained items
- Items that violate Kenyan law or consumer protection regulations
- Adult/obscene content
- Weapons, controlled substances or hazardous materials
- Items misrepresented in photos or descriptions
All users may NOT:
- Harass, threaten or abuse other users
- Submit false reviews or misleading information
- Attempt to circumvent platform fees
- Use the platform to collect personal data without consent
- Engage in fraudulent transactions
Violations may result in immediate account suspension and reporting to relevant Kenyan authorities.
7. Limitation of Liability
To the maximum extent permitted by Kenyan law, Zuri Marketplace shall not be liable for:
- Any loss arising from transactions between buyers and vendors
- Product quality, accuracy, safety or legality
- Delivery failures or delays by vendors
- Loss of data or business interruption
- Any indirect, incidental or consequential damages
Our total liability to any user shall not exceed the subscription fees paid to us in the three months preceding the claim.
8. Dispute Resolution — View Full Policy →
In the event of a dispute between a buyer and vendor, please follow our Official Dispute Resolution Process. We resolve all reported disputes within 7 days.
Escalation Process:
- Direct Resolution (Day 1–3): Buyer contacts vendor via WhatsApp to resolve
- Zuri Mediation (Day 4+): Contact richard@zurimarket.co.ke with transaction details
- Formal Complaint: Submit written complaint with M-Pesa receipts and WhatsApp screenshots
- Vendor Action: Zuri Marketplace may suspend or remove vendor if misconduct is confirmed
Zuri Marketplace reserves the right to make final decisions regarding vendor standing on the platform based on dispute outcomes.
9. Termination
Zuri Marketplace reserves the right to terminate or suspend any vendor account at any time for violations of these terms, without prior notice. Vendors may cancel their subscription at any time by contacting richard@zurimarket.co.ke
10. Governing Law
These Terms and Conditions are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.
Applicable Kenyan legislation includes but is not limited to: The Consumer Protection Act, The Data Protection Act 2019, The Computer Misuse and Cybercrimes Act 2018.
